General Terms and Conditions of Sale (GTCS) – OrthoZenPlus™

1. Purpose
These General Terms and Conditions of Sale govern the contractual relationship between OrthoZenPlus™ (hereinafter referred to as "the Seller") and any individual or entity wishing to make a purchase on the website orthozenplus.com (hereinafter referred to as "the Customer").
They define the rights and obligations of both parties in connection with the sale of products offered by OrthoZenPlus™.
2. Acceptance of the GTCS
By placing an order, the Customer fully and unconditionally accepts these General Terms and Conditions of Sale, without any restriction or reservation.
The Seller reserves the right to modify these GTCS at any time, with the applicable terms being those in effect at the time of the order.
3. Products
The products offered for sale are those described on the website orthozenplus.com.
The main features of the products are indicated, along with the prices in euros, all taxes included (TTC), excluding delivery fees.
The Seller reserves the right to modify its catalog at any time, without prior notice.
4. Price
The prices indicated on the website are in euros, all taxes included (TTC).
Delivery fees are additional and will be specified before the order is confirmed.
The Seller reserves the right to modify prices at any time, but products will be invoiced based on the prices in effect at the time of the order.
5. Order
The Customer can place an order on the website orthozenplus.com by following the indicated process.
The validation of the order constitutes acceptance of these GTCS, the description of the products, the price, and the payment terms.
The Seller confirms the order by sending a summary email to the Customer.
6. Payment
Payment is made online through the secure methods available on the website (credit card, PayPal, etc.).
Payment is due immediately upon ordering.
The Seller is not obligated to proceed with delivery if full payment has not been received.
7. Delivery
Products are delivered to the address provided by the Customer during the order.
Delivery times are provided as an indication and do not engage the Seller’s responsibility in case of delay, unless the delay exceeds 30 days.
Delivery fees and terms are specified during the order process.
The Customer is required to check the condition of the products upon delivery and report any anomalies to the carrier and the Seller within 48 hours of receipt.
8. Right of Withdrawal
In accordance with Article L221-18 of the Consumer Code, the Customer has a period of 14 days from the receipt of the product to exercise their right of withdrawal, without justification or penalty.
The product must be returned in its original condition, complete, unused, and in its original packaging.
Return shipping costs are the responsibility of the Customer, unless the product is defective or there was a shipping error.
Refunds will be made within 14 days of receipt and validation of the return.
9. Warranty
The products benefit from the legal warranty of conformity and the warranty against hidden defects in accordance with Articles L217-4 and following of the Consumer Code.
In case of a defective or non-conforming product, the Customer may request a replacement or refund according to the applicable conditions.
10. Liability
The Seller’s liability cannot be engaged in case of improper or abusive use of the products sold.
The Seller cannot be held responsible for any indirect damages related to the use of the products.
11. Personal Data
The personal data collected is necessary for processing orders and managing the commercial relationship.
It is processed in accordance with the privacy policy available on the website.
12. Intellectual Property
All content on the website orthozenplus.com is protected by copyright.
Any reproduction or use without authorization is prohibited.
13. Applicable Law and Jurisdiction
These GTCS are governed by French law.
In case of a dispute, the competent courts are those of the jurisdiction where OrthoZenPlus™ is located, unless otherwise provided by mandatory provisions.
